Caroline County Board of Zoning Appeals

Composition

Four (4) citizens of Caroline County including one (1) alternate status; appointed by the local Executive and confirmed by the local legislative body.

Term of Office

Three (3) years, an indefinite number of consecutive terms may be served. Chairman and Co-Chairman will serve for one (1) year; terms may run concurrently if so determined by its peers.

Meetings

Meetings are held on the third Tuesday of every month at 7:30 p.m. at the Health & Public Services Building, Denton, Maryland, or in Special Session as the need arises; meetings are open to the public.

  1. The application fee for Special Use Exceptions is $400.00 (non-critical area) or $600.00 (critical area); for a Variance the fee is $250.00 (non-critical area) or $500.00 (critical area) and to file an appeal the fee is $400.00. Applications will not be processed until a completed application and the fees are received. No fees will be refunded after the Public Hearing Notice is published.
  2. A maximum of 4 applications are accepted each month and are processed on a first come first serve basis by submission of a completed application and payment of fees.
  3. The Public Hearing Notice is published for 2 weeks in the Times-Record and may also be published in the Star Democrat; in addition the property will be posted.
  4. A copy of the Public Hearing Notice is mailed to all adjoining property owners and may be mailed to all property owners up to 1,000 feet from the subject property.
  5. The applicant, neighboring property owners and any known parties with an interest will receive a notice stating the date, time and location the application will be heard, approximately 2 weeks before the hearing. If a notice is not received please contact the office.
  6. Either the applicant or an authorized representative of the applicant must be present at the hearing.
  7. The applicant should bring any drawings, plats or photographs which describe the property and support your application to the hearing.
  8. All hearings are scheduled to begin at the same time and the order in which the hearings are held is determined that night. On occasion hearings have continued past 11:00 p.m.
  9. Decisions of the Board are usually made the night of the hearing, but the hearing may be continued or the decision delayed until a later date.
  10. The day after the hearing, the decision of the Board is available by calling (410) 479-8100 after 9:00 a.m.
  11. A copy of the Board's decision will be mailed to the Applicant and to other interested parties.
  12. For commercial and industrial special use exception applications, five (5) legible, full and complete copies of all exhibits, including electronic media, to be introduced by the applicant shall be delivered to the office at least fourteen (14) days prior to any hearing. The exhibits delivered shall be introduced by the applicant into evidence at the public hearing. No other exhibits other than rebuttal shall be permitted to be introduced by the applicant without specific permission given at the public hearing.
